The “free speech” defence is going to be put to a big test in a lawsuit involving former NFL star Matt Kalil and his model ex-wife.
Haley Kalil’s lawyer recently told TMZ that they feel the lawsuit filed against the Sports Illustrated swimsuit model will be dismissed.
“We moved to dismiss the complaint because Minnesota has a longstanding commitment to free speech, which is important now more than ever,” lawyer Matthew Bialick said.
“Allowing a lawsuit to proceed against a woman for sharing a truthful, autobiographical account of sexual trauma would directly undermine those core values. We believe the motion will be granted.”
What did Haley say about Matt?
In court documents obtained by Page Six, Haley said that Matt had a “specific anatomical incompatibility that rendered a normal sexual relationship impossible” and that the pair had a “loving union that was ultimately hindered by an unfortunate physical incompatibility.”
“Plaintiff’s complaint seeks to hold a woman in the public eye civilly liable for providing a truthful, autobiographical account of sexual trauma she suffered and described as having led to the end of a highly publicized celebrity marriage with an NFL football star,” the court papers added.
Matt’s lawyer Ryan Saba said his client believes the motion will be “completely denied” in court.
“Haley Kalil’s motion to dismiss does not dispute the fact that she wantonly disclosed private and intimate details about Matt Kalil that resulted in widespread ridicule and unwanted attention,” Saba told TMZ Sports, adding that a “spouse does not have a right to expose private and confidential marital and sexual details for the purpose of profiting.”
The lawsuit stemmed from an appearance Haley made on a popular livestream in November 2025. During the stream on Twitch with host Marlon Garcia, she said that the size of Matt’s manhood was “the biggest factor” in their divorce, comparing it to “two Coke cans, maybe even a third.”
When discussing what led to their split, Haley said, “We were trying to do the damn thing,” before stopping herself from directly saying the reason out loud and typing it on her phone before handing it to the streamer.
An exasperated Garcia then asked if she was being serious, to which she flopped her arm down on the table and saying: “Dead a**, for our whole marriage, dead a**.”

“But I was going to try it all. We tried it all: Therapist, doctors. Not even lying … Looked up lipo-type s***. That’s why it’s kinda funny. It’s like my life is a comedy and it kinda writes itself.
“That was the biggest factor … Love him, but he’s my homie … No, because he’s like 0.01% of the population. We’ve tried, impossible unless you’re going to be in tears type s***.”
Marlon said the reason was one of the “craziest stories” he had heard.
What are details of the lawsuit?
Matt’s lawsuit alleges Haley’s comments gave the former football star “unwanted attention and invasive commentary from the public.”
He claims his family has been “forced to endure the ongoing public circulation of these degrading and deeply personal statements.”
Kalil married Haley in 2015 and they divorced in 2022. The former Carolina Panther remarried in 2024 to Keilani Asmus, with whom he shares a one-year-old son.
The lawsuit claims Asmus has been the subject of messages that were “increasingly frequent, disturbing and alarming in nature over time.”
According to the lawsuit, Kalil is suing Haley for invasion of privacy for revealing “highly intimate and private facts” about him. He is seeking more than US$75,000 in damages and requesting a jury trial, the New York Post reported.
